Misfits provides creative services including but not limited to:

• •Advertising and campaign marketing
• •Digital design services

All services are provided in person or through direct collaboration. Our website serves as an informational platform and contact point. Specific terms for each project are outlined in individual service agreements.

When using our website, you agree not to:

• •Copy, reproduce, or scrape content without authorization
• •Engage in any malicious activity that could harm our website or systems
• •Submit false or misleading information through contact forms
• •Attempt to gain unauthorized access to our systems or data
• •Use our website for any unlawful purpose

We reserve the right to terminate access to our website for any user who violates these terms.

Website Content:

All content on this website, including text, graphics, logos, images, and software, is the property of Misfits and is protected by intellectual property laws. You may not use, copy, or distribute this content without our written permission.

Client Deliverables:

Upon full payment for services rendered, ownership of final deliverables transfers to the client. However, Misfits retains the right to use completed work in our portfolio, website, and promotional materials unless otherwise agreed in writing.

Preliminary Work:

All preliminary designs, concepts, sketches, and unused materials remain the property of Misfits unless specifically purchased by the client.

Client Materials:

Clients are responsible for ensuring they have the legal right to use any materials (logos, photos, text, etc.) they provide to us. Clients indemnify Misfits against any claims arising from the use of client-provided materials.

Payment terms are specified in individual service agreements and may vary by project. Generally:

• •Payment terms are outlined in the project contract
• •An upfront payment is typically required to begin work
• •Final payment is due upon project completion or as specified in the contract

Cancellations & Refunds:

If a client cancels a project after work has commenced, the upfront payment is non-refundable and is retained as compensation for work completed. Additional charges may apply for work performed beyond the initial deposit.

We do not offer refunds for completed services. Any disputes regarding payment or deliverables should be raised within 30 days of project completion.

We stand behind the quality of our work and guarantee that services will be performed with professional skill and care.

Service Guarantee:

We guarantee that our services will meet the specifications outlined in the project agreement. If issues arise, we will work to resolve them promptly.

Error Correction:

If errors or defects in delivered work are identified, we will address and correct them at no additional charge, provided they are reported within the warranty period.

Website & Application Warranty:

For web design and development projects, we provide a 3-month warranty from the date of launch. This covers technical issues and bugs but does not include design changes or new feature requests unless otherwise agreed.

Specific limitations of liability, including maximum liability amounts and excluded damages, must be discussed and agreed upon in person as part of individual project agreements.

To the extent permitted by law, Misfits shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services or website.

Applicable Law:

For projects based in Kosovo, these Terms of Use and any service agreements are governed by the laws of Kosovo. For projects based outside Kosovo, particularly within the European Union, EU law shall apply.

Dispute Resolution:

Any disputes arising from these terms or our services shall be resolved through the courts of Prishtina, Kosovo, or through binding arbitration as mutually agreed by both parties.

We encourage clients to contact us directly to resolve any issues before pursuing formal legal action.

Either party may terminate a service agreement under the conditions specified in the project contract.

Notice Period:

Unless otherwise specified, a 1-month written notice is required for project termination.

Work in Progress:

Upon termination, all work in progress is considered canceled. The client is responsible for payment of all work completed up to the termination date.

Termination does not affect either party's rights or obligations that arose before termination.

Upon project completion and full payment, we deliver final files in formats appropriate for the project:

• •Design projects: Source files (AI, PSD, etc.) and export formats (PDF, PNG, JPG)
• •Web projects: Production-ready code and necessary deployment files
• •Print projects: Print-ready files in specified formats

File formats and delivery specifications are confirmed during project initiation. Additional file formats may be provided upon request for an additional fee.

Our website may contain links to partner websites and third-party resources. These links are provided for your convenience and information.

We do not control or endorse the content of third-party websites and are not responsible for their content, privacy policies, or practices. Accessing third-party websites is at your own risk.

We reserve the right to modify these Terms of Use at any time. Changes will be effective immediately upon posting to our website.

We will notify users of significant changes by updating the "Last updated" date at the top of this page. For active projects, we will communicate material changes directly to affected clients.

Continued use of our services after changes constitutes acceptance of the modified terms.
